Terms of Service
Version 1.0Effective date: 23 July 2026Last updated: 23 July 2026
By reading these Terms of Service you are entering into a binding agreement with EGG Lab S.r.l.. If you do not agree, you may not use the service. These Terms apply to end users of the mobile app. Partner venues are subject to a separate contract.
1. The service
Barside is a mobile application that allows people temporarily away from their home city to meet other users through a virtual bancone (bar counter) associated with partner venues, before physically visiting those venues.
The service is operated by EGG Lab S.r.l., Via Ghirza, 1 – 00198 Rome, Italy (VAT/CF: 18642451001, REA: RM-1798024, Share capital: €3,000.00). General enquiries: info@barsidetonight.app.
Barside is designed to facilitate genuine social moments. What happens between people after they meet through the service is entirely up to them — what is not tolerated is harassing behaviour, unsolicited advances, or pressure directed at other users. Such behaviour is prohibited and constitutes a violation of these Terms.
Event display order
Events in the discovery feed are not shown in random order, nor based on payments made by venues. The order is determined by three combined criteria:
- Personal relevance: how many of an event's themes match your interests and venues you have rated positively in the past. Active only if you have enabled personalisation in settings.
- Venue quality: venues with a high average feedback score receive a small visibility boost.
- Daily rotation: a factor that changes every day to ensure different venues surface cyclically, preventing the same venues from always occupying the top positions.
A venue's subscription plan does not influence its position in the organic discovery feed. The list shows the first 20 events; you can load more by scrolling down or tapping the dedicated button.
2. Access and requirements
Minimum age
Barside is reserved exclusively for people who are 18 years of age or older. By registering you declare, under your own responsibility pursuant to artt. 46–47 DPR 445/2000, that you are of legal age. In the event of a false declaration, Barside reserves the right to immediately suspend the account and take appropriate legal action.
Devices and connectivity
Access to the service requires a smartphone compatible with iOS or Android, an internet connection, and a valid email address. Barside is not responsible for any connectivity costs charged by your carrier.
Territory
The service is currently available in Italy. Barside reserves the right to expand or restrict geographic availability at any time.
3. Your account
Registration
You may register via email and password or via supported OAuth providers (Google, Facebook, Apple). The information provided must be truthful and up to date. Creating accounts on behalf of third parties or with false identities is not permitted.
Security
You are responsible for keeping your account credentials confidential. Any activity carried out through your account is your responsibility. In the event of unauthorised access, contact support@barsidetonight.app immediately.
One account per person
Creating more than one user account is prohibited. In the event of suspension, re-registering to circumvent the measure is also prohibited.
Display name
Your display name (display_name) must comply with the conduct rules in section 4. It must not contain contact information (email addresses, phone numbers), URLs, offensive language, or terms that could mislead other users. Maximum length: 30 characters.
4. Conduct rules
Barside enforces a zero-tolerance policy for objectionable, abusive, discriminatory, or harassing content and for any behaviour that violates these rules. Reports we receive are reviewed and, when substantiated, result in removal of the content and ejection of the abusive user from the platform within 24 hours.
By using Barside you agree to comply with the following rules in every interaction on the platform, including messages in the bancone, private chats, and your personal profile.
Prohibited actions
- Sending offensive, discriminatory, threatening, or harassing messages.
- Sharing sexually explicit or unsolicited content.
- Publishing URLs, phone numbers, or email addresses in the virtual bancone.
- Spamming or unsolicited promotion of products, services, or other channels.
- Persisting after an explicit refusal (e.g. a rejected brindisi).
- Impersonating others or falsifying your identity.
- Collecting or storing other users' personal data without their consent.
- Using automated tools (bots, scripts) to interact with the service.
- Circumventing security measures or attempting to access unauthorised data.
- Using the service for illegal purposes or to organise unlawful activities.
Moderation
Barside reserves the right to remove content, suspend, or ban accounts that violate these rules, including without notice in the most serious cases. Users can report misconduct via the dedicated function in the app.
Reputation system and automated decisions
Barside assigns each user a reputation score (0–5) calculated from feedback received by other event participants. This score becomes publicly visible after completing 3 events.
The score may also be affected by automatic aggregate penalties: when 3 or more participants at the same event report the same type of misconduct without referencing a specific message, the system automatically applies a uniform penalty of −0.10 points to all virtual bancone participants at that event (excluding the reporter). This process occurs automatically, without individual review by Barside, and is applied only once per event+category pair.
You have the right to object to this automated processing under Art. 22 GDPR by writing to privacy@barsidetonight.app. In that case your profile will be excluded from the automatic aggregate penalty mechanism for future events.
5. User-generated content
Your responsibility
You are solely responsible for the content you publish on Barside (messages in the bancone, profile text, etc.). By publishing content you declare that you hold the rights to it and that it does not infringe any third-party rights.
Licence to Barside
By publishing content on Barside you grant EGG Lab S.r.l. a non-exclusive, royalty-free licence, limited to the provision of the service, to display, transmit, and temporarily store that content to the extent necessary for the platform to function. This licence ends upon deletion of the content or account.
Ephemeral nature
Bancone messages are permanently deleted 24 hours after an event closes. Private chat messages are deleted 24 hours after the chat expires. Barside does not guarantee retention of content beyond these terms.
6. Bancone, Brindisi and La Catena
Virtual bancone
The virtual bancone is a collective, public conversation space: every message is visible to all participants registered to the event. There is no expectation of privacy for messages sent in the bancone.
The Brindisi
The brindisi (toast) is the only mechanism for starting a private conversation with another user. You may send a maximum of 2 brindisi per event. A rejected or accepted brindisi consumes your allowance; one that expires without a response (e.g. the other user has left the bancone) returns the slot to you. After a rejection you may not send a new brindisi to the same person in the same event.
Sending repeated brindisi after a rejection, or with harassing intent, constitutes a serious violation of these Terms and may result in immediate account suspension.
La Catena
La Catena is an optional feature you can enable or disable at any time in settings. By enabling it you consent to Barside notifying your connections when you are in a city different from your home city, and vice versa — so you can meet up at an event and pick up where you left off. No location data is shared directly — notifications only indicate the city you are currently in.
Connections within La Catena are formed exclusively on the basis of explicit mutual consent from both users, after both have physically attended the same event.
Event registration
You may have a maximum of 3 active registrations at the same time. Registering for an event implies an intention to attend physically. A registration not followed by actual attendance at the venue negatively affects your reliability score.
7. Feedback obligation
Participation in Barside events includes the obligation to leave feedback at the end of each event. Feedback is an integral part of the platform's social contract: it ensures service quality for the entire community.
You have 24 hours to complete it. If you do not, you will be unable to register for new events until you do. Once 72 hours have passed since the end of the event the feedback expires automatically and the block is lifted.
Feedback is anonymous towards other users. Barside processes the data in aggregated form to calculate the reputation score, visible on your profile after completing at least 3 events.
8. Suspension and account closure
By you
You may delete your account at any time from the app settings (Settings → Account → Delete account) or by writing to privacy@barsidetonight.app. Deletion results in the pseudonymisation of historical messages (which remain as [deleted user]) and the removal of identifying data within 30 days.
By Barside
Barside may suspend or close your account in the following cases:
- Violation of these Terms, including the conduct rules.
- False declaration of age.
- Use of the service for illegal purposes.
- Attempts to circumvent security measures.
- Repeatedly harassing behaviour despite warnings.
- Prolonged inactivity (more than 24 months).
In cases of serious violation (illegal content, sexual harassment, threats), suspension may be immediate and permanent without notice.
9. Limitation of liability
Third-party content
Barside provides a technology platform. Content published by users in the bancone and private chats is the sole responsibility of the person who published it. Barside is not liable for user-generated content, without prejudice to the moderation actions it undertakes in good faith.
User behaviour
Barside is not responsible for user behaviour inside partner venues or outside the platform. Physical interactions that take place as a result of using the app are the sole responsibility of the people involved.
Service availability
Barside endeavours to ensure service availability to a commercially reasonable extent (target: 99.5% monthly), but does not guarantee uninterrupted service. We are not liable for damages arising from outages, malfunctions, or data loss.
Partner venues
Barside is not responsible for the quality, safety, or accuracy of information provided by partner venues. An event's description, including bancone photos, is provided by the venue under its own responsibility.
Maximum limit
To the fullest extent permitted by applicable law, Barside's total liability to you may not exceed the amount you have paid for the service in the 12 months preceding the event giving rise to the claim. The service is free for end users: the limit is therefore zero, except for damage caused by Barside's wilful misconduct or gross negligence.
9. Electronic invoicing for partner venues
Obligation under Italian law
Pursuant to Legislative Decree 127/2015, Barside is required to issue electronic invoices via the Sistema di Interscambio (SDI) for all paid plans. Before activating a paid plan, each partner venue must provide the following mandatory billing data:
- Business name (legal entity name or sole trader's full name)
- VAT number (for Italian VAT-registered entities) and/or Tax Code
- Registered address: street and number, postcode, city, province, country
- Tax regime (RF01 Ordinary, RF19 Flat-rate, or RF18 Other)
- SDI recipient code (7 alphanumeric characters) or a certified PEC address for receiving electronic invoices — at least one is mandatory
The venue guarantees the accuracy and currency of the data provided. Barside is not responsible for invoices not delivered or rejected by the SDI due to incorrect or incomplete data. Billing data may be updated at any time from Account → Fatturazione; changes apply to invoices issued after the update.
For corrections to already-issued invoices, the venue must contact support@barsidetonight.app within 30 days of issuance.
10. Intellectual property
Barside, the logo, the word mark "Barside", the interface, the code, and all original content on the platform are the property of EGG Lab S.r.l. or the respective rights holders.
You may not reproduce, distribute, modify, or create derivative works from these elements without written authorisation. Use of the Barside brand for unauthorised commercial purposes is prohibited.
11. Changes to these Terms
Barside reserves the right to update these Terms. In the event of material changes, we will notify you via the app or email with at least 14 days' notice. By continuing to use the service after the effective date, you accept the updated Terms.
In the event of changes that significantly reduce your rights, you have the right to withdraw from the service and delete your account before the effective date.
12. Governing law and jurisdiction
These Terms are governed by Italian law. For any dispute relating to these Terms or the use of the service, the Court of Rome shall have jurisdiction, unless a mandatory provision of law applicable to you as a consumer provides otherwise.
If you are a consumer resident in the European Union, you may access the online alternative dispute resolution platform (ODR) provided by the European Commission: ec.europa.eu/consumers/odr.
